Can Nissan dealerships deny a recall?

So my 2000 Pathfinder that I just got as a gift still has 2 recalls out on it and in the middle of fixing a bunch of rust on the body panels, I took a wheel off and found that half of the strut tower has rusted off and is kinda just using the frame as a spring. It's been that way for about a year atleast because I saw the car last year(uncle's car) and remarked to him that his suspension seems very soft. If the damage is very severe, is it possible that my nissan dealership just won't do the recall because of damage or will they still do it but need to change more parts out/charge us for extra parts. via /r/cars http://ift.tt/2uciFAn
