Bought tires, tires weren't correct; didn't notice for near a year. Noticed, called and was told they'd swap the right tires on. Now telling me no.


In 2016 I lost two tires at the same time on my Mazda because construction was going on, on my street. They didn't blow, but there was noticable pull to the left so I went to a fairly close by tire store.I bought a full set of 4 tires, 245 width. The tires put on my car were 225s, but I never noticed because I just assumed... Well, they couldn't have put the wrong tires on, right? I just never bothered to check. 10 months later I'm working on my car with my buddy and I see my tires are 225s, say "That's not right" and the day after went down to the shop.They took a look at my purchase in their system, then my tires and confirmed that yes: they put on the wrong tires. They're the same brand and all, but 20mm shorter in width. They told me they could either refund the full amount or order the correct tires and swap them for me for free. I opted for the full set of 245s, but they only had 3 in stock and said to come back in 2 weeks or later to get it done.Unfortunately in trying to pass emissions during that period, my RX-8 was put in an un-drivable state, and has been in the shop ever since. It's now been roughly a month since I was in their tire shop. This issue is still not solved, but I'm getting somewhere with it at least (I hope).I called them today and told them why I haven't been in yet, as well as that I still intend to get the full set put on. The tires have at most another 200 miles on them from when I talked to them the first time. The manager told me that they weren't going to do it. That "you can't just have free tires for a year. We'd have replaced them if you came back within a day or two."Truth be told, not many miles have been put on my RX-8 in the past year. I didn't drive it once all winter because it sucks arse in the snow+ice, where my Caprice is perfectly suited for it. Not to mention that I haven't driven it since it broke. They listed the mileage I was at when the tires were put in, and it's 4,000 less than it's at now.So here's the dilemma. I paid for something I did not get; while I accept that a good deal of time has passed, that does not excuse the previous fact. The tires they put on are no where near worn out. I was told that they would put the correct tires on, but now they're telling me they won't do a thing.It's worth mentioning that I have logs of the phone calls I made. I record every incoming and outgoing call. I live in a single-party consent state where so long as I am part of the conversation and I consent to the recording; it is legal.In the calls I made today, the first person I spoke to prior to the manager recognized me and told me he remembers that they were supposed to order and put the right tires on.What should I do here?TL;DRI bought 245s for my car and the shop put on 225s. I noticed 10 months later and was told they'd put the proper tires on my car for free after they ordered them.
