Why do people do some illegal things while driving, but not others?

My wife and I were talking about how it's kind strange (to us) that someone would be speeding, swerving between cars,cutting people off and all the while being on their phone. Yet they won't use the carpool or express lane because they don't have enough people in the car, or it's a double white line (in the US that means it's illegal to go over).Why is that?
